Terms of Service

These Terms govern use of LongToss Tracker, operated by Cutter Nation / Jonathan Sintes. By using LongToss, you agree to these Terms and the Privacy Policy. A parent or legal guardian must approve and supervise use by a minor.

Measurement tool—not medical advice

LongToss records a throwing process. It estimates the athlete's phone position from a selected Point Zero and records likely throwing motion, counts, time, notes, and related statistics. It does not measure the ball's flight or landing, guarantee exact distance, diagnose injury, prescribe training, or replace a coach or licensed medical professional.

Use common sense. Stop throwing if it hurts or you feel unwell. Do not continue to hit a distance, count, streak, or personal record. Discuss training with your coach. Seek a licensed physician or qualified sports-medicine professional for persistent pain, numbness, weakness, dizziness, unusual symptoms, or other concerns.

Assumption of risk and safe use

Baseball and softball throwing, walking a field, and outdoor training involve inherent risks. You are responsible for deciding whether you are fit to participate; choosing a safe area; following coach, league, facility, and medical guidance; protecting people and property; and using the device without creating a distraction. To the maximum extent permitted by law, you assume the risks of your participation and use of estimated app data.

Subscriptions

LongToss Pro is offered through Apple's in-app purchase system at the price displayed by Apple, currently $4.99 monthly or $49.99 annually. Eligible new subscribers may receive the introductory trial displayed by Apple. Payment is charged to the Apple ID at confirmation. The subscription renews automatically unless canceled at least 24 hours before the end of the current period. Manage, cancel, or restore through Apple. Refund requests for Apple purchases are handled under Apple's processes and applicable law.

Accuracy and availability

GPS and motion results are estimates affected by device placement, satellite visibility, buildings, weather, permissions, battery state, operating-system limits, and body movement. Automatic detection may miss real throws or record misfires. Use the accuracy display, manual log, and Exclude Last Misfire control. The service is provided “as is” and may change, experience interruptions, or contain errors.

Acceptable use and intellectual property

You receive a limited, personal, non-transferable right to use LongToss. Do not misuse the service, attempt unauthorized access, disrupt operation, unlawfully reverse engineer, or copy and redistribute protected code, graphics, content, reports, or branding. Your content and data

You retain ownership of profile photos, notes, and exports. You are responsible for the information you enter and people with whom you share it. Do not share another person's precise location or personal information without authorization. Local data can be exported or deleted in the app as described in the Privacy Policy.

Limitation

To the maximum extent permitted by law, Cutter Nation and its owner, contractors, and licensors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost data, or lost profits arising from the service. Nothing in these Terms excludes liability that cannot legally be excluded. Any total liability is limited to the greater of the amount paid for LongToss in the preceding 12 months or US $100, where permitted.

Changes, termination, and law

You may stop using LongToss at any time. We may suspend misuse and may update these Terms with a revised date and appropriate notice. California law applies, and disputes will be handled in San Diego County unless mandatory consumer law requires otherwise. If part of these Terms is unenforceable, the remaining terms continue.
